Workplace Posters Required in Texas

Employers in Texas are required to display notices or posters in the workplace to inform employees of their rights and protections afforded by federal and state labor laws.   There are certain workplace posters that must be displayed by all employers. Requirements for other posters vary based on number of employees, industry, and other factors.

Workplace Posters All Texas Employers Must Display

Regardless of the business’s size or industry, there are a number of posters that every employer must display under Texas and federal law. These are:

  • Employee Rights Under the Fair Labor Standards Act (lists minimum wage)
  • Employee Polygraph Protection Act (concerning the use of lie detectors)
  • Your Rights Under USERRA (Uniformed Services Employment and Reemployment Rights Act)
  • Job Safety and Health: It’s the Law (outlines employee rights under OSHA)
  • Notice to Employees of Workers’ Compensation Insurance

Other Workplace Posters Many Texas Employers Must Display

  • Employers with 50 or more employees for 20 or more workweeks must post the Employee Rights and Responsibilities Under the Family and Medical Leave Act.
  • Employers with 15 or more employees must post Equal Employment Opportunity Is the Law and its supplement
  • Any Texas business entity that is not a public employer (federal government, state government, etc.) is subject to the Texas Payday Law and therefore must display the Texas Payday Law
  • Employers liable under the Texas Unemployment Compensation Act (TUCA) must display the Unemployment and Payday Law Poster, which contains information on both the Texas Payday Law and the TUCA.
  • Agricultural employers also need to post the following:
  • – Migrant and Seasonal Agricultural Worker Protection Act Notice
  • – Employee Rights Under the H-2A Program

Worker’s Compensation Poster Requirements

While most Texas employers are not required to offer workers’ compensation insurance (government contractors excepted), they are required to post a notice to inform employees whether or not coverage is provided.

  • Employers that do offer workers’ compensation coverage must post the Employer’s Notice of Ombudsman Program.
  • Government contractors must provide workers’ compensation insurance. Governmental entities require that workers’ comp coverage information be posted at their construction sites.

Workplace Posters for Federal Contractors

Employers who receive federal grants and contracts must display these workplace posters:

  • Equal Employment Opportunity Is the Law
  • Pay Transparency Nondiscrimination Provision
  • Employee Rights on Government Contracts
  • Notification of Employee Rights Under Federal Labor Laws
  • Notice to All Employees Working on Federal or Federally Financed Construction Projects

Workplace Posters for Public Agency and Governmental Employers

  • State agencies and employers of law enforcement, fire fighters, EMS, paramedics, and correctional officers must post the Notice Regarding Certain Communicable Diseases and Eligibility for Workers’ Compensation Benefits.
  • Public employers must post You Have the Right Not to Remain Silent, the Texas Whistleblower Act poster and Workers Right to Know Notice which details employees’ rights to know about exposures to hazards in the workplace.

Displaying Posters

Workplace posters must be conspicuously placed in a location where all employees can clearly see them and access them. Breakrooms, lobbies, and other areas where employees commonly gather usually fulfill these requirements.
